What actually depends on fault

People think fault decides everything. It doesn't. Under NSW MAIA 2017, the first 52 weeks of statutory benefits — weekly income support and medical — are paid regardless of who caused the crash. At-fault drivers get the same early care as not-at-fault ones.

What fault actually changes:

  • Damages. Only available if you're not at fault (or partly at fault under 61%) and your injury is non-threshold.
  • Benefits past 52 weeks. Not-at-fault non-threshold claimants continue to receive weekly and medical benefits. At-fault claimants hit the 52-week wall unless the injury is catastrophic.
  • Your car. Coordinated behind the scenes as part of your claim. Repair and replacement sit with insurers — not a centrepiece here.
